ZBA asks P&Z to enforce decision on lakefront house

SALISBURY — The public hearing before the Zoning Board of Appeals on the Haubrich home at 144 Millerton Road ended quietly Tuesday, Aug. 11, as attorneys for the Haubrichs and neighbor Anne Marie Nonkin indicated a settlement between the parties had been reached and the two pending appeals from Nonkin were withdrawn.

No details of the settlement were  revealed.

However, the board promptly went into executive session, and voted unanimously to ask board attorney Peter Herbst to draft a letter to the Planning and Zoning Commission asking that body to enforce the ZBA ruling last summer revoking the certificate of occupancy for the Haubrich house on Lake Wonoscopomuc.

ZBA Chairman Jeff Lloyd, interviewed the next morning, said the action “ is going to create some controversy.

“ZBA interprets the regulations but we have no power to enforce anything.�

Lloyd said that, according to Herbst, since all appeals have been withdrawn the August 2008 decision is law.

So the long-running story is not over just yet.

“You just can’t ignore a decision a board makes,� said Lloyd. “If our decision is not enforced then why bother having zoning?�

My husband Tom, our friend Jim Jasper and I spent the day at Hancock Shaker Village in Pittsfield, Massachusetts. A cold, blustery wind shook the limbs of an ancient apple tree still clinging to golden fruit. Spitting sleet drove us inside for warmth, and the lusty smells of manure from the goats, sheep, pigs and chickens in the Stone Round Barn filled our senses. We traveled back in time down sparse hallways lined with endless peg racks. The winter light was slightly crooked through the panes of old glass. The quiet life of the Shakers is preserved simply.
